Please read Section 8. It requires most disputes to be handled in individual arbitration and includes a class action waiver. You may opt out of Section 8 within 30 days. Small-claims cases and claims for personal injury from our food or beverages are not forced into arbitration.
1. Acceptance of Terms
By accessing or using the Mici Handcrafted Italian website, mobile ordering platform, or any related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Services. We may update these Terms from time to time; continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
2. Use of the Website and Online Ordering
You agree to use the Services only for lawful purposes. You are responsible for the accuracy of any information you provide when placing an order, creating an account, or signing up for marketing communications, including your name, phone number, email address, and delivery or pickup details. We reserve the right to refuse or cancel any order at our discretion, including for suspected fraud or errors in pricing or product information.
3. SMS / Text Message Marketing
By checking the SMS opt-in box at checkout or otherwise providing your mobile number and affirmatively opting in, you consent to receive recurring automated marketing text messages (for example, promotions, discounts, and menu updates) from Mici Handcrafted Italian at the mobile number you provide.
Message frequency varies.
Message and data rates may apply.
Consent to receive marketing text messages is not a condition of any purchase.
You may opt out at any time by replying STOP to any message. You may also opt out by any other reasonable method, including emailing Support@Miciitalian.com or contacting us at a restaurant and clearly asking us to stop sending marketing texts. We will process opt-out requests promptly and, in any event, within the time required by applicable law (currently not to exceed ten business days).

After we receive an opt-out, we may send one non-promotional confirmation that you have been unsubscribed.
Carriers are not liable for delayed or undelivered messages.
We will not sell, rent, or share your mobile number or SMS opt-in consent with third parties for those third parties’ own marketing purposes. We may share that information with service providers who send messages on our behalf and who are not permitted to use it for their own marketing.

4. Email Marketing
By providing your email address and opting in, you agree to receive marketing emails from Mici Handcrafted Italian. You may unsubscribe at any time using the link provided in any marketing email, or by contacting us at Support@Miciitalian.com.
5. Intellectual Property
All content on the Services — including logos, text, graphics, and images — is the property of Mici Handcrafted Italian or its licensors and may not be used without prior written permission.
6. Disclaimer of Warranties; Limitation of Liability
The website, mobile ordering platform, and related online features are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, except to the extent such warranties cannot be disclaimed under applicable law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that menu items, prices, or availability displayed online will always be current.
To the fullest extent permitted by law, Mici Handcrafted Italian is not liable for any indirect, incidental, special, or consequential damages arising from your use of the website or online ordering platform.
Nothing in these Terms limits or excludes liability for: (a) personal injury or death to the extent caused by our food, beverages, or negligence, where such a limitation is prohibited by law; (b) our gross negligence or willful misconduct; or (c) any other liability that cannot be limited or waived under the law of Colorado or under any non-waivable consumer-protection statute that applies to you.
7. Governing Law; Venue
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs Section 8. If you are a consumer residing in Arizona, Texas, or another state, any consumer-protection, privacy, or telemarketing statute of your state of residence that cannot legally be waived continues to apply to you.
For any dispute that is not subject to arbitration under Section 8 — including the carve-outs in Section 8 — and except where a non-waivable law requires otherwise, you agree that the dispute must be brought exclusively in the state courts located in Denver County, Colorado, or in the United States District Court for the District of Colorado, and you consent to personal jurisdiction in those courts.
8. Dispute Resolution; Limited Arbitration; Class Action Waiver
This section is limited on purpose. It does not send every disagreement to arbitration. It does not take away small-claims court or a claim for personal injury from our food or beverages.
Informal resolution. Before either of us files a lawsuit or an arbitration demand, we will send the other a short written notice of the dispute, the facts, and the relief sought. Send notices to us at Support@Miciitalian.com and 2373 Central Park Blvd #107, Denver, CO 80238. We will use the email or postal address we have for you. We will then wait 30 days and try in good faith to resolve it. Missing this step does not waive a claim. It only delays filing until the 30 days have run, unless a shorter period is required to preserve the claim.
Agreement to arbitrate. Except for the carve-outs below, you and Mici agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms, the Services, an order, or our text or email messages — including claims under the Telephone Consumer Protection Act and similar state laws — by binding individual arbitration. The American Arbitration Association will administer the case under its Consumer Arbitration Rules. The Federal Arbitration Act governs this agreement. The case may be handled by phone, video, or writing. If a hearing is required, it will be held in the county where you live, or in Denver County, Colorado, if you do not live in the United States. A court may enter judgment on the award.
What the arbitrator decides. The arbitrator may award the same individual relief a court could award on an individual claim. Except as stated in the class action waiver paragraph, the arbitrator — not a court — decides disputes about the meaning, scope, or enforceability of this Section 8, including whether a particular claim belongs in arbitration.
Class action waiver. You and Mici may bring claims only in an individual capacity. You waive any right to a class action, collective action, private attorney general action, or other representative proceeding, in court or in arbitration. Class arbitration is not allowed. If a court holds that this waiver is unenforceable as to a particular claim, that claim must proceed in court, not in arbitration. That holding does not pull other claims out of Section 8.
Carve-outs — these stay in court. Section 8 does not require arbitration of: (a) an individual case filed and kept in small-claims court; or (b) a claim for personal injury or death arising from our food or beverages. Either of us may also go to court for temporary injunctive relief to protect intellectual property or to enforce the class action waiver.
Mass filings. If 25 or more people represented by the same counsel, or by coordinated counsel, bring substantially similar claims against Mici within any 90-day period, those demands will be administered in staged batches of no more than 10 at a time. The AAA Mass Arbitration Supplementary Rules apply to the extent they do not conflict with this paragraph. A court may enforce this batching rule.
30-day opt-out. You may reject this Section 8 by emailing Support@Miciitalian.com within 30 days after you first agree to these Terms. Include your name, the mobile number or email you used with us, and a clear statement that you opt out of arbitration and the class action waiver. If you opt out, Section 8 does not apply to you. The rest of these Terms still apply, and you can still stop texts and emails at any time.
Fees and survival. We will pay AAA filing and administrator fees to the extent the Consumer Rules or applicable law require the company to pay them. This Section 8 survives the end of these Terms and your use of the Services. By agreeing to arbitration, you and Mici waive a jury trial on claims covered by this section.
9. Changes to These Terms
We may revise these Terms at any time by posting an updated version on this page. The “Last updated” date at the top of this page will change when we do. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. If we make a material change to Section 8, we will not apply that change to a dispute we already knew about, and we will give you a fresh 30-day opt-out window for the revised arbitration terms.
10. Privacy
Our collection and use of personal information, including information you provide to place an order or opt in to texts or email, is described in our Privacy Policy. The Privacy Policy is part of how we operate the Services and should be read together with these Terms.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. If any part of Section 8 is found unenforceable, the rest of Section 8 should be enforced to the maximum extent permitted by law, except as specifically provided in the class action waiver paragraph.
